Do not use the software accompanying this Agreement (“SCIT PRO”) until you have carefully read the following Agreement. Using the Software (or authorizing any other person to do so) indicates your acceptance of the terms and conditions contained in this Agreement. If you do not agree with the terms and conditions of this Agreement, do not download or install this software. This Agreement sets forth the terms and conditions for licensing of the Software from SOUTHERN MARYLAND WEATHER. (“Licensor”)
While we make every effort to provide accurate, up-to-date weather conditions, we do not guarantee the accuracy or timeliness of weather data. As with any client/server operation, there are some conditions beyond the Licensor’s control such as network latency, hardware incompatibilities, and other obstacles which can delay or distort weather data as provided. Licensor strongly encourages all users to obtain multiple sources of weather information in cases of emergency. The End User acknowledges that the data may contain errors or inaccuracies and should not be used as the exclusive source of weather data. Software and its data products are provided “AS IS” and without any warranty of any kind, express or implied. End User shall be solely liable for all interpretations, predictions, decisions, judgments and actions taken with respect to the Software and its data products. USE OF THIS PRODUCT IS AT CUSTOMER’S SOLE RISK.

“There are no express or implied warranties respecting this service, or the services provided hereunder ( including the fixing of all defects or errors that may be contained in the applicable software offering) , including but not limited to the implied warranties of merchantability and fitness for a particular purpose. The warranties and remedies set forth in this agreement are exclusive in lieu of all others whether oral, written, express or express or implied. Southern Maryland Weather will not be liable for any failure or delay in performance due in whole or in part to any cause beyond Southern Maryland Weather’s reasonable control. In no event shall Southern Maryland Weather be liable for any special, indirect, incidental or consequential damages; nor shall Southern Maryland Weather be liable to subscriber for any damages whether based on contract, tort, or any other legal theory beyond a refund of subscriber fees. This Agreement shall be governed by and interpreted, construed and enforced in accordance with the laws of the State of Maryland.”
PRODUCT USAGE NOTE
“SCIT PRO” may not be retransmitted, resold, reversed engineered, or redistributed for any reason without written permission from Southern Maryland Weather. Southern Maryland Weather retains the right to bring legal action against violators of this policy. Those desiring to resell or broadcast our service should contact us at support (at) somdweather.com. Southern Maryland Weather also retains the right to change our fees at any time.
