This Agreement sets forth the terms and conditions for licensing of the Software from SOUTHERN MARYLAND WEATHER. (\u201cLicensor\u201d)<\/p>\n
While we make every effort to provide accurate, up-to-date weather conditions, we do not guarantee the accuracy or timeliness of weather data. As with any client\/server operation, there are some conditions beyond the Licensor\u2019s control such as network latency, hardware incompatibilities, and other obstacles which can delay or distort weather data as provided. Licensor strongly encourages all users to obtain multiple sources of weather information in cases of emergency. The End User acknowledges that the data may contain errors or inaccuracies and should not be used as the exclusive source of weather data. Software and its data products are provided \u201cAS IS\u201d and without any warranty of any kind, express or implied. End User shall be solely liable for all interpretations, predictions, decisions, judgments and actions taken with respect to the Software and its data products. USE OF THIS PRODUCT IS AT CUSTOMER\u2019S SOLE RISK.<\/p>\n

The warranties and remedies set forth in this agreement are exclusive in lieu of all others whether oral, written, express or express or implied. Southern Maryland Weather will not be liable for any failure or delay in performance due in whole or in part to any cause beyond Southern Maryland Weather’s reasonable control. In no event shall Southern Maryland Weather be liable for any special, indirect, incidental or consequential damages; nor shall Southern Maryland Weather be liable to subscriber for any damages whether based on contract, tort, or any other legal theory\u00a0beyond a refund of subscriber fees.
